By booking and participating in a Seabob rental with Fajardo Seabob Rentals, I understand and agree that this activity involves water, swimming, ocean conditions, equipment operation, physical activity and inherent risks.
I confirm that I know how to swim and that I am physically able to participate in this activity. I understand that ocean conditions may change and may include waves, current, wind, rocks, reef, marine life, other swimmers, boats and other hazards.
I agree to follow all safety instructions provided by Fajardo Seabob Rentals staff. I agree not to operate the equipment in a reckless, unsafe or improper manner. I agree to stay within the permitted riding area and return the equipment when instructed.
I understand that all rentals are subject to weather, ocean conditions, safety rules and availability. Fajardo Seabob Rentals may cancel, delay or reschedule any rental if conditions are unsafe.
I accept responsibility for the proper use of the rented equipment during my rental period. I agree to return the equipment in the same condition received, normal wear excepted. I understand that I may be responsible for damage caused by misuse, negligence or failure to follow instructions.
I agree that minors must be accompanied by a parent or legal guardian. If I am signing on behalf of a minor, I confirm that I am the parent or legal guardian and accept full responsibility for the minor's participation.
I confirm that I do not have any medical condition that would make participation unsafe, including but not limited to serious heart conditions, breathing problems, recent injuries, pregnancy-related risks, dizziness, seizures or any condition that may be affected by swimming or water activity.
I voluntarily assume all risks related to this activity and release Fajardo Seabob Rentals, its owners, employees, representatives and affiliates from liability for injury, loss, damage, accident, delay, cancellation or any claim related to my participation, except where prohibited by law.
I agree to indemnify and hold harmless Fajardo Seabob Rentals from any claim, damage, injury, loss, cost or expense caused by my actions, negligence, misuse of equipment, failure to follow safety rules or participation in the activity.
I authorize Fajardo Seabob Rentals to use photos and videos taken during the activity for marketing, social media and promotional purposes, unless I request otherwise in writing before the rental begins.
Customer cancellations require at least 24 hours notice. Weather or unsafe ocean condition cancellations may be rescheduled or refunded at the discretion of Fajardo Seabob Rentals.
By typing my full name and submitting this waiver, I confirm that I have read, understood and agreed to this Liability Waiver, Safety Agreement and Rental Terms.
